OSHKOSH, Wis–The owner of the Oshkosh Arena denies allegations that it is insolvent and unable to pay any of its bills. In an affirmative defense filing as part of a foreclosure lawsuit against Fox Valley Pro Basketball and Greg Pierce by the arena’s builder, Bayland Buildings, attorneys argue that the facility is not in default on its mortgage–despite not making a payment since March.

FVPB and Pierce also admit they have not paid more than $625,000 in property taxes to the city of Oshkosh, but that does not put them in breach of their contract with Bayland. The filing does not provide any financial information on the operations of the arena, and argues that Bayland will have to prove insolvency and default in court.
The arena is currently operating in receivership at the request of Bayland. Its website lists no upcoming events, although its main tenants, the Wisconsin Herd have announced six home game dates for their upcoming season.
